Commercial Mediation

Civil and Commercial Mediation

Participation in mediation is voluntary and the process is private and confidential, it brings structure that ordinary negotiation lacks, while reducing costs and time. The decision to settle and the terms of an agreement rest solely with the parties themselves, and not the mediator. The role of the mediator is to facilitate the negotiations, in a non-bias or judgemental manor.

Commercial mediation is between companies, sole traders, or individuals to come together to resolve financial disputes, or contract negioations, the process is confidential and “without prejudice”, this means that what is said or written cannot be used in later proceedings or in a court of law if the mediation does not settle. 

We adhere to the practice and standards of the Civil Mediation Council and our mediator is trained in their standards. Disputes can be mediated even if a Lawsuit/Litigation has commenced.

Except in unusual circumstances, the parties themselves should attend the mediation. They are usually accompanied by their legal representative. In the case of a party that is a company or other association, its representative will need to have authority to reach a binding settlement at the mediation.

Online Dispute Resolution (ODR)

Online Dispute Resolution (ODR) enables parties in dispute to settle their differences virtually (over the internet) without the need to attend in person. Disputes are resolved through a blend of online tools with a qualified mediator, using real-time confidential discussion rooms over a secure internet site.  Our mediators typically use Zoom, though are open to using alternative platforms, such as MS Teams. 

ODR is suitable for disputes of all sizes and can accommodate any number of parties across any number of locations.    

Online mediation offers a cost-effective alternative to conventional mediation, saving parties both time and money whilst reducing the need to arrange a neutral venue at a mutually convenient location.

The mediator will assess whether this process will be appropriate for both parties in the dispute. Zoom can also be used for the initial 1:1 meeting when doing the intake process and then meet face to face at a venue. There are many options available to all parties.

Fixed Fee Mediation (Claims Under €130K)

To encourage Parties in dispute to consider mediation, we offer a fixed fee mediation service for disputes with a claim value of €130K, or less.   

Fixed Fee Mediation Costs

  • 8-hour mediation: €1,000.00 + VAT per party
  • 4-hour mediation: €600.00 + VAT per party

The above quoted fee include:

  • All reasonable preparation 
  • Administration fee

Additional Time

Should the parties agree for the mediation to exceed the scheduled duration, an hourly rate of €150.00 + VAT per party will be applied.

Travel Costs 

Mediators do not charge travel time once it is under 1 hour, but any reasonable travel expenses are charged in addition, at cost.

Venue Costs 

This will be agreed prior to the meeting as online options are available if deemed suitable by our mediator, which will reduce costs. The venue cost will be divided equally by both parties unless otherwise agreed.

Small Claims Mediation (Claims Under €25K)

We offer a cost-effective online mediation service, using the latest specialist technology to host a virtual mediation with a fully qualified Online Dispute Resolution (ODR) mediator.  Online mediation is available on all platforms from desktop PC/MAC to mobile telephone; the only requirement is a reliable internet connection and zoom.  

Our Small Claims Mediation scheme is for claims with a value of €25K or less. 

Fee Structure:

  • Claim value: €0.00 to €25K, 
  • Mediation duration: 4-hour online mediation (virtual or telephone)
  • Cost (per party): €500.00 + VAT
